Tokaikolo ‘ia Kalaisi won the appeal launched by Feohi’anga Mo’uifo’ou ‘ia Kalaisi

Tokaikolo ‘ia Kalaisi congregation won the appeal launched by Feohi’anga Mo’uifo’ou ‘ia Kalaisi a breakaway faction from them.
Court of appeal this morning dismissed the case submitted by Sione Havili Maile, Sione Amanaki and Feohi’anga Mo’uifoou ‘ia Kalaisi.
Lord President of the Court of Appeal Justice Owen Paulsen says, Tokaikolo could perhaps be criticized for failing to reclaim the property earlier but that would have made no difference.
He continued in his ruling that evidence from the appellant was unable to show that they were induced by Tokaikolo to believe they had the right over the properties at Ha’ateiho.
The appeal comes after Lord Chief Justice Owen Paulsen on November 9th 2016 ruled for the Feohi’anga Mouifoou ia Kalaisi to vacate the properties within 30 days from that ruling.
This includes the chapel, stewards’ residence, school and hall.
The appeal dismisses given the Tokaikolo ‘ia Kalaisi the rights over these properties.
