Trial of Senior Fisheries Officer for road death adjourned to April 26th

The trial of a Senior Officer of the Ministry of Fisheries, Poasi Ngaluafe is being adjourned to April 26th to allow counsel time to make submissions on a point of law before judgment.
Ngaluafe was charged with causing the death of a man while driving with alcohol in his body in excess of 250 micrograms per liter of breath, contrary to a section of the Traffic Act, causing the death of Uini Kava 46-year-old of Tofoa in May last year.
The accused also faces an alternative count of driving a motor vehicle while under the influence of drink.
The trial started on April 4th at the Supreme Court.
The Crown had submitted that the victim was seen by an eyewitness allegedly sitting in the middle of the left lane of the road towards Tu’atakilangi.
The court heard that he did not pass out but was nodding his head like he was falling asleep.
The Crown called three witnesses including the eyewitness and doctor, while the defense did not give any evidence.
The trial was held before Hon. Mr. Justice Cato.
